The Lombardy Radon Law (L.R. 3/2022) is a cornerstone of regional health legislation, representing the full and organic implementation of national (Legislative Decree 101/2020) and European (BSS 2013/59/Euratom) directives.
This regulation does not limit itself to passively adopting the state rule, but builds an active governance system for radon risk in Lombardy, assigning precise and differentiated responsibilities:
- ARPA Lombardy: The technical-scientific arm. It manages the regional measurement database, validates radiometric data, and supports the Region in identifying risk areas.
- ATS (Health Protection Agencies): Responsible for surveillance and control. They verify compliance with measurement obligations by employers and owners of premises open to the public, applying sanctions in case of non-compliance.
- Municipalities: Integrate radon criteria into Building Regulations, conditioning the habitability (agibility) of new constructions and renovations on compliance with concentration limits.
Lombardy has been a pioneer in Italy, anticipating many provisions thanks to the synergy with the regulation on basement recovery (L.R. 7/2017), which already imposed preventive measurements as an essential condition for residential conversion.
Objectives and Intervention Strategies
The primary declared objective is the drastic reduction of lung cancer incidence attributable to Radon gas, which in Lombardy represents a significant threat due to the geological conformation of the territory (Alpine and Pre-Alpine massifs). The regulatory strategy is developed on four fundamental pillars:
- Scientific Identification of Risk Areas: Detailed mapping leading to the definition of Priority Areas (Resolution 5469/2025), i.e., municipalities where it is estimated that more than 15% of buildings exceed the threshold of 300 Bq/m³.
- Protection of Sensitive Subjects: Absolute priority for intervention and monitoring in schools of all levels, kindergartens, healthcare facilities, and nursing homes (RSA), where the stay of vulnerable subjects (children, elderly, sick) requires higher safety standards.
- Urban Planning Integration: Radon is no longer treated as an "ex post" problem, but enters "ex ante" design. No new building can be declared habitable if it does not integrate anti-radon construction details (ventilated crawl spaces, waterproof membranes) guaranteeing levels below 200 Bq/m³.
- Measurement Obligation in Workplaces: Capillary extension of controls to all underground workplaces and, in Priority Areas, also to those on the ground floor, overcoming the old distinction that excluded many commercial activities.

High Risk Lombardy Provinces

Province of Bergamo
Vast areas of the Bergamo valleys (Val Seriana, Val Brembana) and the foothills present very high concentrations due to the local geology rich in uranium-bearing rocks.
Province of Sondrio
Almost entirely classified as a priority area. The granitic and alpine nature of the Valtellina territory generates some of the highest concentrations in Italy.
Provinces of Varese and Como
The northern lake and pre-alpine area shows significant values, with numerous municipalities classified as high risk in the mountain belt.
Province of Brescia
Val Camonica and Val Trompia are historically known for the presence of radon, with dozens of municipalities in the priority belt.
Province of Lecco
The pre-alpine zones and municipalities facing the lake show spots of relevant risk, especially where the bedrock outcrops.
Po Valley
Generally at lower risk, but beware: radon can accumulate here too due to building materials or local faults. Always verify.
Lombardy Basement Recovery and Radon

The Restriction of L.R. 7/2017
In Lombardy, the recovery of basements for residential or commercial purposes is regulated by Regional Law March 10, 2017, n. 7. This rule allows making habitable rooms previously intended as cellars or warehouses, but only if radiological safety is guaranteed.
Before presenting the building practice (SCIA or Building Permit), it is necessary to demonstrate that the radon concentration is below the legal limits, or prepare preventive mitigation systems.
What does "Lombardy Radon Basement Recovery" mean?
This is one of the most frequent searches because it represents the meeting point between urban planning and health protection. If you are transforming a cellar into a habitable tavern, a warehouse into an office, or a basement into a commercial activity, you must certify that radon is below 300 Bq/m³ (or 200 Bq/m³ for new uses from 2025).
Without this certification, habitability (currently "SCA" – Certified Report of Agibility) cannot be issued.
Operating Procedure
- Preventive measurement: If time permits, perform an annual measurement (12 months) before works to have a reference value.
- Mitigation during renovation: If there is no time for preventive measurement, install "radon-proof" systems such as ventilated crawl spaces, waterproof membranes, or provision for active depressurization.
- Post-operam testing: At the end of the works, it is mandatory to perform a new measurement to confirm the effectiveness of the interventions.
- Documentation: The test report from the accredited laboratory must be attached to the habitability application.

Publication of Priority Areas (December 2025)
Resolution 5469 of 09/12/2025 published the updated list of Lombardy municipalities classified as Priority Areas. The deadlines for mandatory measurements start from this date.
Start of Measurements (Within 24 months)
Operators of activities subject to obligation (ground floors in priority areas, underground premises everywhere, schools, and RSAs) must start the annual measurement within 24 months of publication.
Transmission of Results
At the end of the monitoring year, results must be communicated via the ARPA/SUR portal. Failure to transmit constitutes a sanctionable non-compliance.
Criminal Sanctions (Art. 205 D.Lgs 101/2020)
In case of failure to measure: arrest from 1 to 6 months or fine from 2,000 to 10,000 euros. In case of failure to adopt corrective measures after exceeding limits: arrest up to 3 months or fine from 10,000 to 50,000 euros.
